Acceptance of Terms

By accessing or using the services provided by chiggembim B.V. ("chiggembim," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services or access our facilities.

These terms apply to all members, visitors, and users of chiggembim's fitness club, website, and related services located at Lindelaan 149, 9767 JA Groningen, Netherlands.

Company Information

chiggembim is a women-only fitness club operated by chiggembim B.V., a company registered in the Netherlands with registration number B25236218 and VAT number NL62025632B01.

Membership and Services

chiggembim provides fitness services exclusively to women aged 18 and over. Our services include but are not limited to:

• Access to fitness equipment and facilities
• Group fitness classes
• Personal training sessions
• Wellness programs and nutrition guidance
• Locker room and changing facilities

Membership fees, terms, and conditions will be specified in your membership agreement. All fees are subject to change with appropriate notice as required by law.

User Obligations and Conduct

As a member or user of chiggembim services, you agree to:

• Provide accurate and complete information when registering
• Follow all facility rules and safety guidelines
• Respect other members, staff, and property
• Use equipment properly and report any damage immediately
• Maintain appropriate fitness attire and hygiene standards
• Not engage in any illegal, harmful, or disruptive behavior
• Not share your membership access with others
• Comply with the women-only policy of our facility

Health and Safety

You acknowledge that physical exercise involves inherent risks. Before using chiggembim's services, you should:

• Consult with a healthcare provider if you have any health concerns
• Inform our staff of any medical conditions or physical limitations
• Exercise within your physical capabilities
• Follow all safety instructions provided by our staff

chiggembim is not responsible for any injuries that may occur as a result of your participation in fitness activities, except where such injuries result from our negligence.

Intellectual Property

All content, materials, and intellectual property associated with chiggembim, including but not limited to our name, logo, website content, training programs, and proprietary methods, are owned by chiggembim B.V. or our licensors.

You may not reproduce, distribute, modify, or create derivative works from any of our intellectual property without express written permission. The chiggembim name and branding are protected trademarks.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. Please review our Privacy Policy to understand how we handle your personal data.

Payment Terms

Membership fees are due in advance and must be paid according to the terms specified in your membership agreement. Late payments may result in suspension of services and additional fees. All prices are in Euros (EUR) and include applicable taxes unless otherwise stated.

Cancellation and Termination

You may cancel your membership according to the terms specified in your membership agreement and applicable Dutch consumer protection laws. chiggembim reserves the right to terminate memberships for violations of these Terms of Service, non-payment, or inappropriate conduct.

Upon termination, you must immediately cease using all chiggembim services and return any property belonging to chiggembim. Termination does not relieve you of any outstanding payment obligations.

Limitation of Liability

To the fullest extent permitted by law, chiggembim B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or facilities.

Our total liability to you for any claims arising from these Terms of Service or your use of our services shall not exceed the amount you have paid to chiggembim in the 12 months preceding the claim.

This limitation of liability does not apply to damages caused by our gross negligence or willful misconduct, or where prohibited by applicable law.

Indemnification

You agree to indemnify and hold harmless chiggembim B.V., its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services, violation of these Terms of Service, or violation of any rights of another party.

Force Majeure

chiggembim shall not be liable for any failure or delay in performance of our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government regulations, pandemics, or other acts of God.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of significant changes by posting the updated terms on our website and updating the "Last Updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms or your use of chiggembim's services shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If you are a consumer, you may also have the right to bring proceedings in the courts of your country of residence.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any membership agreement you sign, constitute the entire agreement between you and chiggembim regarding your use of our services.
